MintWorld Game is a distributed application launched by Not Gonna Make It S.L, currently running on the Polygon Network, that combines traditional core game and blockchain mechanics. This Site and App are only an interface allowing participants to own, transfer, battle, and develop unique digital monsters as well as the ability to own land plots and other items (collectively referred as Game NFTs). The game’s native token, MWG, is a multifunctional utility token which serves as in-game currency for economic interactions and as governance token influencing decision making. Users are entirely responsible for the safety and management of their own private Polygon wallets and validating all transactions and contracts generated by this website before approval. Furthermore, as the MintWorld Game smart contract runs on the Polygon Network, there is no ability to undo, reverse, or restore any transactions. This website and its connected services are provided “as is” and “as available” without warranty of any kind. By using this Site you are accepting sole responsibility for any and all transactions involving Not Gonna Make It S.L.

OWNERSHIP

  • i. You Own the NFT. Each MintWorld Game NFT is stored on the Polygon blockchain. Your ownership of these Game NFTs will give you certain rights and privileges within the Services, for as long as we make the Services and such rights and privileges available to you. You are responsible for all payments, fees, and costs when engaging in any transactions involving Game NFTs, including, without limitation, the purchase price, transaction fees, fees associated with your secondary or subsequent sales of Game NFTs, and all other fees associated with your use of the Game NFTs via the Services. Not Gonna Make It S.L owns the App and the Site. You acknowledge and agree that Not Gonna Make It S.L owns all legal right, title and interest in and to all other elements of the Site and App, and all intellectual property rights therein (including, without limitation, all Art, designs, systems, methods, information, computer code, software, services, website design, "look and feel", organization, compilation of the content, code, data and database, functionality, audio, video, text, photograph, graphics, and all other elements of the App (collectively, the "Materials"). You acknowledge that the Materials are protected by copyright, trade dress, patent, and trademark laws, international conventions, other relevant intellectual property and proprietary rights, and applicable laws. All Materials are the copyrighted property of Not Gonna Make It S.L, and all trademarks, service marks, and trade names associated with the App or otherwise contained in the Materials are proprietary to Not Gonna Make It S.L. Except as expressly set forth herein, your use of the App does not grant you ownership of or any other rights with respect to any content, code, data, or other Materials that you may access on or through the App

  • ii. Personal Use. Subject to your continued compliance with these Terms, ot Gonna Make It S.L. grants you a worldwide, royalty-free license to use, copy, and display the underlying Art of your owned Game NFT, along with any extensions that you choose to create or use, solely for the following purposes: (i) for your own personal, non-commercial use; (ii) as part of a marketplace that permits the purchase and sale of your MintWorld Game NFT, provided that the marketplace cryptographically verifies each NFT owner’s rights to display the Art for their NFT to ensure that only the actual owner can display the Art; or (iii) as part of a third party website or application that permits the inclusion, involvement, or participation of your NFT, provided that the website/application cryptographically verifies each Game NFT owner’s rights to display the Art for their NFT to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the Game NFT leaves the website/application.

  • iii. Commercial Use. Subject to your continued compliance with these Terms, Not Gonna Make It S.L grants you an unlimited, worldwide license to use, copy, and display the Game NFT Art for the purpose of creating derivative works based upon the Art (“Commercial Use”). Examples of such Commercial Use would e.g. be the use of the Art to produce and sell merchandise products (T-Shirts etc.) displaying copies of the Art. For the sake of clarity, nothing in this Section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of MintWorld Game NFTs generally, provided that the marketplace cryptographically verifies each Game NFTs owner’s rights to display the Art for their game NFTs to ensure that only the actual owner can display the Art; (ii) owning or operating a third party website or application that permits the inclusion, involvement, or participation of Game NFTs generally, provided that the third party website or application cryptographically verifies each Game NFT owner’s rights to display the Art for their Game NFT to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the Purchased Game NFT leaves the website/application; or (iii) earning revenue from any of the foregoing.

  • You shall not purchase or otherwise acquire any of our token products if you are: a citizen, resident (tax or otherwise), green card holder, incorporated in, owned or controlled by a person or entity in, located in, or have a registered office or principal place of business in the U.S. (a “U.S. Person”), or if you are a person in any jurisdiction in which such offer, sale, and/or purchase of any of our token products is unlawful, prohibited, or unauthorized (together with U.S. Person, a “Restricted Person”). The term “Restricted Person” includes, but is not limited to, any natural person residing in, or any firm, company, partnership, trust, corporation, entity, government, state or agency of a state, or any other incorporated or unincorporated body or association, association or partnership (whether or not having separate legal personality) that is established and/or lawfully existing under the laws of, a jurisdiction in which such offer, sale, and/or purchase of any of our token products is unlawful, prohibited, or unauthorized). You shall not resell or otherwise transfer any of our token products to any Restricted Person. The transfer or resale of any of our token products to any Restricted Person is not permitted.
